How NRIs Can Manage Power of Attorney for Their Bengaluru Rental Property

by Prachi Sharma•20 Jul 2026•14 min read

TL; DR

  • Use a Special Power of Attorney (SPA) limited to rental management not a General Power of Attorney (GPA) unless you genuinely need your representative to sell or mortgage the property too.
  • A POA signed abroad must be authenticated either via Apostille (for the ~125 Hague Convention countries, including the US, UK, UAE, Singapore, Australia and Canada) or via attestation at an Indian Embassy/Consulate for non-Convention countries.
  • Once the POA reaches India, it must be stamped within three months of arrival under the Indian Stamp Act miss this and the Sub-Registrar can refuse to act on it and courts won't admit it as evidence.
  • Since the Registration (Karnataka Amendment) Act, 2025, any POA authorising sale, gift or exchange of immovable property must be compulsorily registered at the Sub-Registrar's office; a POA limited purely to rent collection and property management can be adjudicated and stamped without that full registration, but registering it anyway makes it far harder to dispute later.
  • Your POA holder can register the rental agreement on Kaveri 2.0, run tenant police verification, collect rent into your NRO account, and pay property tax and maintenance but under RBI/FEMA rules they cannot repatriate your rental income abroad to anyone but you, and cannot gift or transfer it to a third party.
  • Rent paid to an NRI landlord is subject to TDS under Section 195 at an effective 31.2%, from the first rupee, unless you apply through Form 13 for a lower or nil deduction certificate.
  • Repatriating rental income above ₹5 lakh in a financial year now requires Form 145 and a Chartered Accountant's Form 146 (the forms that replaced Form 15CA/15CB from 1 April 2026), on top of the USD 1 million per financial year NRO repatriation ceiling.
  • Register the POA, limit its scope, and keep a revocation deed ready misuse of a broadly worded, unregistered GPA remains the single biggest legal risk NRIs face with property back home.

Introduction

If you're an NRI who owns a flat or a house in Bengaluru and rents it out, you already know the basic problem: almost everything involved in managing a rental signing the lease, verifying the tenant, collecting rent, paying property tax, handling a plumbing complaint at 11 pm assumes you're physically in the city. A Power of Attorney (POA) is how you legally hand day-to-day control to someone you trust a parent, sibling, friend, or a professional property manager without having to fly down for every signature.

Done properly, a POA is a well-understood, safe legal instrument that Indian law has specific provisions for when the person granting it lives abroad. Done carelessly an overly broad General Power of Attorney, executed without proper attestation, never registered, handed to someone you don't fully trust it's also the single most common source of property disputes NRIs run into. This guide walks through exactly how to draft, execute, register and use a POA for a Bengaluru rental property, and what your representative can and can't do once they hold it.

1. Decide Between a General POA and a Special POA This Is the Most Important Choice You'll Make

A General Power of Attorney (GPA) gives your representative sweeping authority over the property potentially including the power to sell, mortgage, gift or otherwise transfer it. A Special or Specific Power of Attorney (SPA) limits their authority to the exact tasks you name: signing lease agreements, collecting rent, representing you before the housing society or BBMP, and handling routine maintenance.

For a rental-management use case, there is rarely a good reason to grant a GPA. Indian courts have also been consistently cautious about GPAs used as a substitute for an actual sale deed the Supreme Court's 2011 ruling in Suraj Lamp & Industries v. State of Haryana held that property "sold" merely through a GPA, without a registered sale deed, does not transfer legal title. That ruling was aimed at GPA-based sale transactions, not rental management, but it reflects a broader judicial wariness toward wide, open-ended POAs one more reason to keep the scope of yours narrow and specific.

General POA (GPA)Special POA (SPA)
ScopeBroad can include sale, mortgage, gift, litigation, banking, and managementLimited to the specific powers you list
Best suited forSituations where you genuinely need someone to sell or transfer the property on your behalfRenting out and managing a property while you retain ownership
Risk if misusedHigh a dishonest agent has wide authorityLower authority is confined to named acts
Karnataka registration (2025 amendment)Compulsory if it authorises transfer of immovable propertyNot compulsory if limited to management, but strongly advisable

Draft the SPA to explicitly list what your representative can do: sign and renew lease/rental agreements up to a stated tenure and rent ceiling, collect rent and deposit it into your NRO account, register the rental agreement and complete tenant police verification, pay property tax, BBMP/BWSSB charges and society maintenance, represent you before the housing society, RWA, police station or municipal office for property-related matters, and engage contractors for repairs up to a specified amount. Explicitly exclude the power to sell, gift, mortgage or transfer the property unless you intend to grant that separately.

2. Executing the POA From Abroad: Apostille or Consular Attestation

Because you're not physically in India to sign before an Indian notary, the law requires your signature to be authenticated in one of two ways, depending on where you live.

Your country of residenceAuthentication routeTypical process
Hague Apostille Convention member (US, UK, UAE, Singapore, Australia, Canada, most of the EU around 125 countries)ApostilleSign the POA before a local notary, then get it apostilled by the relevant state/national authority (e.g., Secretary of State in the US). No separate Indian consular attestation is required.
Non-Convention countryIndian Embassy/Consulate attestationAppear in person at the nearest Indian Embassy or Consulate with your passport/OCI card, sign the POA in front of the consular officer, who attests it directly.

Under Section 33 of the Registration Act, 1908, where the principal (you) does not reside in India, the POA must be executed before and authenticated by a Notary Public, court, judge, magistrate, Indian consul/vice-consul, or another authorised representative of the Central Government this is what both routes above are designed to satisfy.

Have an Indian lawyer draft the POA not a generic template specifying your and your representative's full names and addresses, precise property details (survey number, khata number, address), the exact powers granted, and, ideally, an expiry date or review date. Once notarised and apostilled/attested, courier the original to India.

The clock starts the moment it lands in India, not the day you signed it. Under Section 18 of the Indian Stamp Act, 1899, a POA executed outside India must be stamped within three months of its first arrival in the country. Miss this window and the document becomes inadmissible the Sub-Registrar can refuse to act on it, and it won't hold up in court either. Build this deadline into your planning before you courier the document.

3. Stamp Duty, Adjudication and Registration in Karnataka

Once the POA reaches India, it needs to be adjudicated (stamp duty assessed and paid) at the District Registrar's or Sub-Registrar's office, and depending on its scope registered.

ItemCurrent position
Stamp duty on POA (general authorisations)Revised in September 2025: roughly ₹500 for a single authorisation, up to ₹1,000 for POAs covering 5-10 authorisations
Stamp duty on POA authorising property sale/transferAssessed as a percentage of property value, closer to a conveyance, since it functions as a transfer instrument
Compulsory registrationUnder the Registration (Karnataka Amendment) Act, 2025, any POA authorising sale, gift or exchange of immovable property with or without consideration must be registered at the Sub-Registrar's office
POA limited to rent collection and property managementCan be adjudicated and stamped without compulsory full registration, but voluntary registration is strongly recommended for a rental-management POA too, since a registered document is far harder for a tenant, bank, or third party to dispute
Where to registerThe Sub-Registrar's office having jurisdiction over the property's location

In practice, for a Bengaluru rental property, get the SPA adjudicated for stamp duty at the jurisdictional Sub-Registrar's office and register it there as well, even though a pure management SPA may not legally require registration under the 2025 amendment. A registered POA carries far more weight with banks, the housing society, tenants and government offices than an unregistered one, and it removes any ambiguity if a dispute ever ends up before a court or the police.

4. What Your POA Holder Can Actually Do And Where RBI Draws the Line

With a validly executed, adjudicated SPA in hand, your representative can handle the practical side of being a Bengaluru landlord on your behalf:

Finding and onboarding a tenant. They can negotiate and sign the lease agreement (within the rent and tenure limits you've specified), register it through the Kaveri 2.0 portal stamp duty on a rental agreement is typically around 0.5% of the total rent plus deposit for the tenancy period and complete mandatory tenant police verification through the Karnataka State Police's e-Services portal or the Suraksha App. Note that under the Karnataka Rent Amendment Act, 2026, residential security deposits are now capped at two months' rent, and digital registration of the rental agreement through Kaveri 2.0 is mandatory, with a penalty for non-compliance.

Collecting rent and paying outgoings. Rent can be collected directly into your NRO (Non-Resident Ordinary) account, and your POA holder can pay property tax, BWSSB/BESCOM bills, society maintenance, and arrange repairs.

Operating your NRO account within limits. RBI/FEMA rules permit a POA holder to operate your NRO account for permitted local transactions, but the restrictions are specific and important: they can make local payments on your behalf and can remit your rental income to you, the account holder, through normal banking channels but they cannot repatriate the funds to anyone else, cannot gift the money to themselves or a third party, and cannot transfer funds to another NRE account. In effect, the POA holder can manage the money in India but cannot redirect it anywhere except back to you.

Representing you before authorities. This includes the housing society/RWA, BBMP, BWSSB, and, if it ever comes to it, the local police station for a tenancy-related complaint.

What they generally should not do without a separately, explicitly granted authority: sell, mortgage, gift or otherwise transfer the property, or take on liabilities in your name beyond what's listed in the deed.

5. Tax Compliance Your POA Holder Needs to Handle

Rental income earned on an Indian property is taxable in India regardless of your residency status or where the rent is ultimately received and the compliance burden here falls partly on your tenant and partly on you.

TDS on rent paid to an NRI landlord. Under Section 195 of the Income Tax Act, any tenant paying rent to an NRI landlord must deduct TDS at an effective rate of 31.2% (30% plus applicable cess), and unlike Section 194IB, which applies to resident landlords only above ₹50,000 a month this applies from the very first rupee of rent, with no threshold exemption. This is a materially higher deduction than what a resident landlord's tenant would withhold, and it surprises many NRI owners the first time it shows up.

Applying for a lower or nil TDS certificate. If your actual tax liability on the rental income is lower than 31.2% (which it usually is, once eligible deductions and your applicable slab are factored in), you or your POA holder acting for you can apply to the jurisdictional Assessing Officer using Form 13 under Section 197 for a certificate specifying a lower or nil TDS rate. The certificate, once issued, is typically valid for one financial year and needs to be renewed annually. Note that Form 13 applications must currently be verified using a Digital Signature Certificate Aadhaar OTP or mobile OTP are no longer accepted for this filing.

Repatriating the rental income. If you want to move the rent (after tax) out of your NRO account to your overseas account, remittances are subject to the standard NRO repatriation ceiling of USD 1 million per financial year, and for remittances made on or after 1 April 2026 you'll need Form 145 (filed by the remitter) and, once the remittance in a financial year crosses ₹5 lakh, Form 146 (a Chartered Accountant's certificate confirming the tax position). These forms replaced the earlier Form 15CA and Form 15CB under the Income-tax Act, 2025, so if you've handled repatriation before under the old names, the process is largely the same just under new form numbers.

Worked example: Suppose your Bengaluru flat is rented out at ₹40,000 a month. Without a lower TDS certificate, your tenant must withhold 31.2% about ₹12,480 every month and deposit it against your PAN. If your actual computed tax liability on this income works out closer to 10% once you've accounted for the standard deduction, home loan interest (if any), and your slab rate, a Form 13 application approved at that lower rate would bring the monthly withholding down to roughly ₹4,000 a difference of over ₹1 lakh a year that would otherwise sit with the tax department until you claim it back through your annual return.

6. Keeping the POA Safe: Scope, Oversight and Revocation

A POA is only as safe as the person holding it and the boundaries you've drawn around it. A few practical safeguards:

Grant the POA to someone you have full confidence in typically a close family member, or a professional property manager/lawyer with a verifiable track record rather than a broker you've just met. Keep the scope narrow: a rental-management SPA, not a GPA, and put a rent ceiling, tenure limit and explicit exclusions (no sale, no mortgage, no gifting) in the deed itself. Ask for periodic updates rent receipts, maintenance records, copies of the registered lease rather than a purely hands-off arrangement. Consider a time-bound POA (say, one to three years) that you renew consciously, rather than an open-ended one you forget about.

If you ever need to revoke the POA because of a change in circumstances, loss of trust, or simply because the arrangement has run its course execute a Deed of Revocation (before a notary abroad, mirroring how the original POA was executed), and then formally notify everyone who has relied on the original document: the Sub-Registrar (if the POA was registered, the revocation should be registered at the same office), your bank, the housing society, and the tenant. As an added precaution, many lawyers recommend publishing a revocation notice in a local newspaper in the city where the property is located, so that no third party can later claim they were unaware of the revocation.

Practical Checklist Before You Grant a POA

Have a lawyer draft an SPA specific to rental management, not a generic downloaded template. Confirm whether your country of residence is a Hague Apostille member or requires Indian consular attestation, and follow the correct route. Courier the original to India and get it adjudicated and stamped within three months of its arrival track this date carefully. Register the POA at the jurisdictional Sub-Registrar's office in Bengaluru, even if not strictly compulsory for a management-only SPA. Set up or confirm your NRO account details with the bank and share them with your POA holder for rent collection. Apply for a Form 13 lower/nil TDS certificate if your effective tax liability is below 31.2%, and plan to renew it each financial year. Keep your POA holder's authority time-bound and ask for periodic documentation of rent collected, taxes paid, and maintenance carried out.

Conclusion

Managing a Bengaluru rental property from abroad doesn't have to mean choosing between constant travel and blind trust. A correctly drafted, properly attested, adjudicated and ideally registered Special Power of Attorney gives your representative exactly the authority they need to run the property well, while RBI's rules on NRO accounts and Section 195's TDS regime keep your money and tax position protected by default. The paperwork takes real effort to get right the first time, but once it's in place, it's a one-time setup that can smoothly run your property for years.
