The Core Difference

• Sale deed is a specific, individual legal document, the one executed and registered when a property changes hands through a sale. It's a single transaction record
• Title deed is not one specific document. It's an umbrella term for whichever document currently establishes legal ownership of a property, and it could be a sale deed, a gift deed, a partition deed, a settlement deed, a Will, or a conveyance deed, depending on how that particular owner acquired the property In other words, every sale deed is a title deed, since it establishes ownership, but not every title deed is a sale deed. If you inherited your property, your title deed might be a Will or a succession certificate. If it was gifted to you, your title deed is your gift deed. If you bought it, your title deed is your sale deed.

Why the Distinction Actually Matters

When someone asks to see your "title deed," they're really asking for whichever legal document currently proves your ownership, in whatever form that takes. This matters most in two situations.

• When verifying a property before purchase: you need to check the entire chain of title deeds going back through the property's history, not just the most recent sale deed. Each transfer, whether by sale, gift, inheritance, or partition, needs its own valid, registered document in that chain
• When your own ownership doesn't come from a straightforward purchase: if you inherited or received the property as a gift, your bank, buyer, or lawyer will ask for your title deed, and handing over a sale deed that belongs to a previous owner, rather than your own gift deed or succession document, will not establish your ownership

What Documents Can Serve as a Title Deed

• Sale deed: for property acquired through purchase
• Gift deed: for property received through voluntary transfer without payment
• Partition deed: for property received through division of jointly held family property
• Settlement deed: for property transferred as part of a family settlement, often to avoid future disputes

It's the document, or chain of documents, that legally proves you own what you say you own.

Tracing the Title Chain

This is the practical skill that actually protects a buyer, and it goes beyond checking a single sale deed.

• Request title documents going back at least 30 years, tracing every change of ownership in sequence
• Confirm each transfer in the chain was properly executed and registered, whether it was a sale, gift, inheritance, or partition
• Look for gaps. A missing link, an unregistered transfer, or an unexplained jump between owners is a serious red flag
• Cross-check the chain against the mother deed, which traces the property's original ownership before any subdivision, and the encumbrance certificate, which shows registered transactions against the property over a chosen period A property can have a perfectly valid, registered sale deed for its most recent transaction and still carry a defective title, if an earlier document in the chain, say a gift deed two owners back, was never properly executed or had a legal challenge attached to it.

Sale Deed vs Title Deed vs Mother Deed

These three get confused together, so it's worth separating all three clearly.

• Title deed: the general term for whatever document currently establishes ownership, which could be several transactions removed from the mother deed
• Sale deed: one specific type of title deed, used only when the property changed hands through a purchase Think of the mother deed as the root, the title chain as everything in between, and the current title deed, whatever form it takes, as the most recent link.

What to Ask For When Buying a Resale Property

• The seller's current title deed, whatever document form it takes for how they acquired the property
• The full chain of prior title deeds, going back as many transactions as possible, ideally to the mother deed
• A fresh encumbrance certificate, to confirm no undisclosed loans or disputes sit against the property
• Confirmation that every document in the chain was registered, not just executed on paper If the seller's own ownership came through inheritance or a gift rather than a purchase, don't expect a sale deed from them, ask specifically for the correct document type that applies to how they acquired it.
